Netherlands’ DPA finds education agency’s use of algorithms unlawful

The Netherlands’ data protection authority, Autoriteit Persoonsgegevens, investigated the Education Executive Agency’s use of algorithms and found the system could be discriminatory toward certain students. The agency allegedly used students’ personal information to determine which were more likely to abuse the agency’s nonresident student grant. AP Chair Aleid Wolfsen said organizations which do not test its algorithms for potential risks could deal “with a discriminatory algorithm and therefore a discriminatory, unlawful processing of personal data.”
