Latvia’s DVI explains AI images’ data protection implications

Latvia’s Data State Inspectorate issued an advisory regarding whether AI-generated image counts as personal data. In the DVI’s view, images do not constitute personal data and can be preferable to using a real child’s likeness. However, the regulator noted it does not have the authority to assess some cases, such as generated images of children or adults in accidents.
