The European Data Protection Board published version 2.0 of guidelines on technical scope of the ePrivacy Directive’s Article 5(3). The guidelines expand the applicability of the ePrivacy Directive to “similar (tracking) technologies” to third-party cookies and focus on three key elements of Article 5(3), which are “information,” “terminal equipment of a subscriber or user,” and “gaining access” to stored information.
