Spain’s data protection authority, the Agencia Española de Protección de Datos, published a legal analysis to outline its potential enforcement authority under the EU AI Act. The AEPD said Spain has yet to pass a national law that would either designate the AEPD or a new agency as the market surveillance authority to enforce the AI Act once new elements of the regulation enter into force 1 Aug. However, the AEPD asserts it still has data protection enforcement authority when AI systems process personal data.
