The European Data Protection Board published formal guidelines for the second version of Article 37 Law Enforcement Directive following a public consultation. The EDPB guidelines state that Article 35 LED applies to data transfers under Article 37 and should be “applied in light of the principle that the level of data protection applicable in the European Union must not be undermined by the transfer of personal data to another jurisdiction.”
